1. The Parties

This Rental Agreement ("Agreement") is made between Goldy’s Trailers PTY LTD ("Owner") and the individual or entity identified during the booking process ("Renter"). By completing a booking on this website, the Renter agrees to be bound by all terms and conditions listed below.

2. Equipment and Hire Period

• The Equipment: Refers to the specific trailer(s) selected by the Renter at the time of booking.

• Hire Period: Begins at the time the trailer is collected and ends when it is returned to the designated drop-off location.

• Late Returns: Late returns will incur a fee of $[Insert Amount] per hour or part thereof, unless otherwise agreed in writing.

3. Rental Fees and Security Bond

• Payment: Full payment of the hire fee is required at the time of booking.

• Bond: A security bond of $[Insert Amount] may be held. This is fully refundable upon the return of the trailer in a clean, undamaged condition.

4. Insurance and Liability (IMPORTANT)

Goldy’s Trailers PTY LTD does not provide insurance coverage for the Renter.

• Renter’s Risk: The Renter acknowledges that the trailer is hired at their own risk.

• Total Liability: The Renter is 100% liable for any loss, theft, or damage to the trailer during the Hire Period, regardless of how the damage occurred or who was at fault.

• Third-Party Damage: The Renter is responsible for any damage caused to third-party property or vehicles while the trailer is in their possession.

• Towing Vehicle: It is the Renter’s responsibility to ensure their towing vehicle is appropriately insured and rated for the trailer's weight.

5. Condition of Trailer

• Inspection: The Renter must inspect the trailer upon collection. Any pre-existing damage must be noted and reported to Owner before departure.

• Maintenance: The Renter must ensure the trailer is used in a safe and proper manner. This includes checking tyre pressure and ensuring all lights are functioning throughout the hire.

6. Prohibited Use

The trailer must not be:

• Sub-let or used by any person not named in the booking.

• Used for any illegal purpose or to carry hazardous materials.

• Overloaded beyond the trailer’s specified ATM (Aggregate Trailer Mass).

• Driven on unsealed or "off-road" tracks unless specifically authorized.

7. Indemnity

The Renter indemnifies Goldy’s Trailers PTY LTD against all claims, losses, or expenses (including legal fees) arising from the Renter’s use of the trailer, including personal injury or death.

8. Cancellation Policy

• Cancellations made more than 48 hours prior to the hire will receive a full refund.

• Cancellations made within 48 hours will forfeit the deposit amount.

9. Acknowledgment and Signature

By ticking the "I Agree" box on the booking page, I, the Renter, acknowledge that I have read, understood, and agree to the terms of this Rental Agreement. I specifically acknowledge that no insurance is provided and I am fully liable for the replacement cost of the trailer if lost or damaged.
